Padre Cadre Terms of Use

By using this website (the “Site”) or any services provided through this Site, you (“you,” “your” or “User”) agree to the terms of service that Padre Cadre (“us,” “our,” or “we”) have provided. These terms of service (“Agreement” or “TOS”) between us and you supersedes all previous written and oral agreements, representations, and warranties. If you don’t agree with the TOS, please refrain from using the Site.

General

Padre Cadre (http://www.padrecadre.com/) is a social networking website where Users can connect and share their thoughts, ideas, and experiences with fatherhood, life, and other topics. This Site provides a platform where we and Users can post podcasts, videos, blogs, photos, and other written content.

User Conduct

Everyone who visits this Site is required to abide by the following rules of conduct

  • You must be at least 13 years old to have a profile on this Site.
  • Don’t use this Site to abuse, harass, or defame anyone.
  • Don’t post content that contains hate speech, threats, excessive violence or curse words, or pornography. You cannot use this Site to do anything unlawful, misleading, malicious, or discriminatory.
  • Don’t post spam or solicit products or services using this Site.
  • Don’t upload viruses or other malicious code. You cannot do anything that is designed to disable, overburden, or interfere with the normal working of the Site.
  • Don’t use this Site to commit copyright infringement or violate anyone’s intellectual property rights.
  • Don’t use this Site to violate anyone’s right to publicity or privacy.
  • Please use this site to connect with others about fatherhood, but please don’t use this platform to pitch products or services.
  • You may post affiliate links in your posts, but you must disclose that the post includes affiliate links. Links posted on this Site by Users are not an endorsement by us.
  • You may write sponsored blog posts, but you are responsible of complying with the Federal Trade Commission’s rules and using the #ad hashtag when posting about these blog posts. Allowing Users to create sponsored blog posts is not an endorsement by us.
  • S. federal law requires that you only share your accurate and honest opinion based on your personal experience, if you talk about a product or service (16 CFR §§ 255.0–255.5). Failing to do this could result in a fine from the Federal Trade Commission. Padre Cadre shall not be responsible for any claims related to content posted on the Site by Users.
  • We reserve the right to remove any posts or to delete any User’s profile for any reason.

User Profiles

Padre Cadre’s goal is to provide a platform where Users can connect and share their thoughts, ideas, and experiences about fatherhood, life, and other topics. It’s designed only for individual use. Businesses, charities, and other organizations can create a profile on Padre Cadre only with our explicit permission. If you want to create a profile for a company, charity, or other organization, please contact The Center for Men’s Excellence Psychological Corporation at singley@menexcel.com.

Any non-member User who visits the Site can see blog posts, videos, podcasts, and pictures posted by other Users who have set up blogging tools on their profiles, except for posts that are labeled “private” by the author. (“Private” posts can only be seen by the User who created them and those Users who have a password provided by the author to see those posts.) Non-member Users can also post comments on the content they can view; however, only Users who create a profile can create posts.

Users who have profiles on Padre Cadre can participate in the social network platform on this Site. These Users will have a newsfeed where they will see what other Users with profiles are posting in real time, and they can also participate in groups on this Site.

Forum Posts and Messaging on Padre Cadre

Any User who has a profile on Padre Cadre may contribute to forums and in-app messages to other members along with making personal information available as part of their profile. With this functionality, Users may share posts, articles, personal messages, videos, and podcasts on this Site. You will have your own profile page for sharing this content. Anyone who visits this Site will be able to see every blog post, article, video, and/or podcast which you post with the Site’s communication tools.

We may share your content on the Padre Cadre homepage or on any social media platform or other media outlet, but those decisions will be made by us at our discretion.

Having a blog post or any other content on this Site does not entitle you to payment from Padre Cadre for any reason.

Interactions with Other Users.

Though Padre Cadre strives to encourage a respectful user experience through features like the ability to control which categories of Users are able to see specific data elements in their profile, it is not responsible for the conduct of any user on or off of the Services. You agree to use caution in all interactions with other users, particularly if you decide to communicate off the Service or meet in person. You should not provide your financial information (for example, your credit card or bank account information), or wire or otherwise send money, to other Users.

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. YOU UNDERSTAND THAT PADRE CADRE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS USERS OR OTHERWISE INQUIRE INTO THE BACKGROUND OF ITS USERS. PADRE CADRE MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF USERS. PADRE CADRE RESERVES THE RIGHT TO CONDUCT ANY CRIMINAL BACKGROUND CHECK OR OTHER SCREENINGS (SUCH AS SEX OFFENDER REGISTER SEARCHES) AT ANY TIME USING AVAILABLE PUBLIC RECORDS.

License to Use User-Provided Content

You may only share content that you have created or have permission to use on this Site. You will retain the copyright in your original work that you post on this Site. By posting your work on this Site, you grant Padre Cadre a perpetual, non-exclusive, royalty-free, paid-in-full license to use your work, in whole or in part, in any way, for any reason, including advertising and marketing purposes. This license includes the ability to modify your work and sublicense it to others for any reason. If we use any of your content, we may do so without notification or compensation to you.

Links and Sponsorships

We may provide links to other websites on this Site. Providing a link, however, is not an endorsement. We shall not be responsible for any material on any site to which we or any User provides a link. You assume all risk by following a link. We provide no guarantee that any website we link to will be accurate or available.

We reserve the right to post sponsored ads and posts on this Site. Providing the opportunities to others to advertise or promote a product or service is not an endorsement by Padre Cadre. We cannot guarantee the veracity of any statements made by sponsors.

Copyright and Trademarks

Padre Cadre retains the copyright rights in all the content we post on this Site. Users who wish to share, use, or repurpose any of our content must request permission from Padre Cadre by contacting us directly. We will not grant you permission to alter or change our content in any way. Any time we grant someone a license to use our content, we require an attribution to Padre Cadre with the Padre Cadre logo.

“Padre Cadre” and the Padre Cadre logo are our company trademarks and may not be used without our explicit written permission.

Any violation of this policy may result in a copyright, trademark, or other intellectual property right infringement that may subject you to civil and/or criminal penalties.

Digital Millennium Copyright Act (DMCA) Policy

Indemnification

By using this Site, you agree to defend, indemnify, and hold harmless Padre Cadre, our affiliates, and their respective directors, officers, employees, and agents from and against all claims and expenses, including attorneys’ fees, arising out of or related to any activity by you in connection with the Site.

To the extent permitted under applicable laws, User hereby releases Padre Cadre from any and all claims or liability related to any product or service provided through this Site and any conduct or speech, whether online or offline, of any other User.

Modification to these Terms of Service

We reserve the right to change the TOS for this Site at any time as we deem necessary or desirable. We may notify Users of changes by posting notice of the change on the Site. Changes to this Agreement may occur, however, without notice. Any changes to these TOS will be effective upon the changes being made to this document. Your continued use of this Site shall be your acceptance of any changes to this Agreement.

The date at the top of the TOS informs you of the date of the most recent change.

USER EXPRESSLY AGREES THAT USE OF THIS SITE IS AT USER’S SOLE RISK. Privacy Policy

We have the upmost respect for your privacy. When you create a User profile, you must provide your name, username, password, email address, gender, and birthdate. We’ve designed this site with the intent of keeping your User account and personal data protected from indexing by search engines.

We will use the information collected from you to provide and improve our services, which may require us to share some information with third parties. In the event that we sell the business or this Site, that sale will include all User information we’ve obtained via this Site. We will never spam you or sell your information to a third party for other purposes.

When you provide your contact information to us via this Site, you are opting in to receive emails from Padre Cadre. In accordance with the CAN-SPAM Act, you may opt-out from receiving these communications at any time.

We may share your information with a third party if we have a good-faith belief that sharing the information is necessary to comply with a law, regulation, or enforceable government request; to investigate potential violations or technical issues on our website; or to protect against harm to us, our Users, or our affiliates’ rights, property, safety, or to the public as permitted by law.

Dispute Resolution

By using this Site, you agree that any claim, dispute, or controversy you may have against us arising out of, relating to, or connected in any way with this Agreement or this Site, shall be resolved exclusively in a court located in Los Angeles County, California. Delaware law shall govern all disputes related to this Site.

In all claims, disputes, and controversies related to this Agreement or this Site, the non-prevailing party shall be responsible for the prevailing party’s attorneys’ fees in addition to any damages assessed against them.

If you have a dispute with another user on this Site, that conflict must be resolved between you. We will not get involved unless you are violating this Agreement or disrupting this Site.

Miscellaneous

This Agreement shall constitute the entire agreement between the Users and us with respect to the subject matter in this document. No waiver by either party of any breach or default hereunder is a waiver of any preceding or subsequent breach or default.

The section headings used in this Agreement are for convenience only and shall be of no legal force or effect.

If any provision of this Agreement is held invalid by a court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions contained in this Agreement, and the remaining portions of this Agreement shall continue in full force and effect. If a provision is found to be invalid, the parties hereby request that the intention of the invalid provision be upheld wherever possible. The failure of either party to exercise any of its rights under this Agreement shall not be deemed a waiver or forfeiture of such rights or any other rights provided by this Agreement.

Termination

We reserve the right to suspend or terminate any User’s profile and/or blog on Padre Cadre at any time and for any reason. Termination may occur without advance notification. Padre Cadre shall not be liable for any damages for terminating a User.
